Hello Nima, Thank you for reaching out to me and for sharing the issues you are experiencing at 1060 Brickell with the upcoming election on November 30th and with the most recent assessment. We have forwarded your concerns to DBPR to review and have asked them to provide their jurisdiction over these issues. In addition, we have been assisting Dorinda Spahr these past few months, who has filed a complaint with DBPR on your behalf, and currently has an open case number regarding the electronic voting issue. This case is being addressed by DBPR. Unfortunately, DBPR does not have the ability to intervene in elections beforehand but can intervene thereafter and any issues or disputes can be cured within 60 days of an association election. DBPR recommends that a separate complaint be filed for the financial related issues, which will allow them to investigate and intervene and request financial records from the association. We expect that Dorinda will file a separate complaint on this issue on your behalf. We have also forwarded these issues over to the Miami Dade State Attorney’s Office. Please see their response below. "Our office has been meeting with residents and reviewing documents as it relates to potential criminal conduct. Unfortunately, criminal courts do not have the power to order individuals be included or excluded from condominium election ballots. If there are breaches of statute or by-laws that do not involve criminal penalties, you could continue to work with the DBPR as issues arise or consider involvement of civil courts. We will continue to review the documents and information we have to determine if there is evidence of theft or embezzlement. This review will not conclude prior to your upcoming elections, which I know are occurring next week, but we will continue to provide updates when we have them."
